The DPM Contracts reports to the PM, supports the project team, and ensures that the project team is properly trained and supported in contract interpretation and compliance, risk management, and change management. The DPM Contracts is responsible for managing its risk assignments, properly identifying, vetting and advancing potential changes, and ensuring compliance with the contract requirements. The DPM Contracts ensures contract compliance, specifically that the contract rights, remedies, obligations, assignments and risks are maintained among the contracted parties throughout the life of the project.
The DPM Contracts will Work closely with the project controls staff to identify external causes of deviations to the project schedule, accurately record, track and report all cost/schedule impacts associated with changes, and assert change impacts as part of any change order resolution.
The Deputy PM Contracts is responsible for the leadership and management of contract, risk, and change management in support of a projects profitable operation
- Responsible for developing and maintaining a comprehensive knowledge of the project and all contractual documents at all levels: Prime (client/owner), HNTB/client, sub consultant/ HNTB.
- The DPM Contract Manager is responsible for contract management, risk management, and change management.
- In collaboration with the Project Manager (PM), they will take appropriate action to ensure adherence to applicable project-specific contract(s), the Manual of Professional Practice (MPP), and Standards of Performance.
- The CM will draft or co-draft correspondence to the client, review all correspondence and other key communications between the project team and the design-builder/ owner, and between HNTB and its sub consultants for contract compliance, liability considerations, risk and burden shifting, and potential changes.
- Conduct contract reviews of the design subcontract and design-build owner RFP contract. Ensure the contract is conformed for pass-through provisions (in support of EVA). Identify unfavorable terms, risk allocation, and change and dispute procedures.
- Advocate for and facilitate a risk assessment exercise with the design-builder. Promptly after (and in all cases) facilitate an internal risk assessment and mitigation exercise, which will result in a project-specific Risk Register.
- Identify risk assignments made in the general provisions and general requirements. Include in the project Risk Register and ensure that certain risk assignments and provisions are passed through to subcontractors (coordinate with EVA).
- Capture and track all understandings and informal agreements with design-builder made during proposal development, including scope assumptions and exclusions, for incorporation into the contract scope documents.
- Utilization of resources available outside of the project team including:
- Advantage leadership
- Enterprise Value Advantage (EVA) contracts and negotiations resources
- Professional Practice Services (PPS)
- Enterprise Delivery Team (EDT)
- Participate in monthly (minimum) Project Reviews, providing an update on Project Overall Claim/Change Metrics
- Mentors project team members in all aspects of project claims/change management
- The CM will be responsible for reviewing and understanding the general provisions and general requirements and overall structure of the applicable contracts (an analysis of which will be provided by EVA), identifying administrative tasks and deliverables, facilitating and/or conducting risk-management exercises and ensuring project risks are being managed, facilitating the training of project staff in contract competency, implementing change management protocols during project delivery in order to manage changes on the project (including assisting EVA in the resolution of disputes and claims) and for closing out all contractual requirements.
- Review project reports received by sub consultants and those generated by the design team and submitted to the design-builder for commitments and liability.
- Establish processes, forms, and tools for change management (strategic considerations/ gap filling) within the project team and in cooperation with the design-builder.
- Act as the lead person on the project for advancing and defending against potential change orders. The CM will work directly with the design manager and scheduler to quantify impacts due to changes. When needed, the CM may seek support from EVA (typically for contract analysis and merit arguments for sophisticated changes and all disputes).
- Facilitate contracts/ change management training for project team, including a general design-build approach to contract administration and application, and conduct project-specific change management training.
- Chair weekly change management meetings, capture and track all Potential Changes until they are closed or advanced as Requests for Change Orders (RCOs). Ensure contractual compliance with change procedures, including providing of timely notice to the client for all potential changes. Develop merit arguments, quantify all cost and time impacts, complete all RCO elements and submit to the design-builder in accordance with the contract requirements and HNTB interests. Advance disputes in a timely manner and in accordance with the contract requirements and HNTB interests.
- At project close out, responsible for supporting (in support of EVA) all dispute resolution, claims, and litigation issues.
- Must have 10 years of experience, with at least 5 years of being in a Change Order/Claims management position.
- Must have experience being assigned to projects with design fees exceeding $50MM.
- Experience in advancing some schedule delays and claims experience for complex owner/contractor agreements for project fees over $15M.
- Experience working directly for the contractor or architect/engineer is required.
- Bachelors degree in engineering, construction management or financial administration is preferred.
